Attorney Kenneth Rosenfeld Discusses Landmark Case and Legal Challenges

Published on October 1, 2024

In a recent episode of the Startup Show, host Leonard Kim sat down with Kenneth Rosenfeld, president of the Rosenfeld Law Firm, to delve into some of the most significant cases in California’s legal history. The discussion covered Rosenfeld’s defense of Roni Deutch, also known as the “Tax Lady,” and highlighted the challenges of navigating high-profile legal battles, criminal defense, and mental health law.

Rosenfeld, known for his expertise in criminal defense, particularly high-stakes cases, provided listeners with a glimpse into one of the largest cases in California history. Deutch, who pioneered the tax resolution industry, faced an unprecedented 1,700 charges. Rosenfeld was able to secure a full dismissal, proving there was no criminal intent behind Deutch’s business dealings, which had grown too large for her to manage effectively.

Facing 1,700 Counts and Winning

“No other case in California history has ever had 1700 plus counts against somebody in the state. And I handled that case and I handled it to a dismissal for my client,” said Rosenfeld. Despite the enormity of the case, he won by focusing on the lack of criminal intent. Deutch’s business, which negotiated tax settlements with the IRS, became too overwhelming for her to control. Rosenfeld emphasized that this wasn’t a case of fraud but a businesswoman caught in a legal web as her company rapidly expanded.

Rosenfeld also touched on the incredible complexity of the legal process, referencing the “millions of pages” of discovery exchanged between defense and prosecution.

The Intersection of Public Opinion and High-Profile Cases

The conversation shifted to the impact of public perception in high-profile cases, especially when the defendant is a well-known figure. Rosenfeld, who has represented NFL players, Hollywood personalities, and others in the spotlight, noted how the court of public opinion can be challenging to overcome.

When you’re representing a public figure, the presumption of innocence is often overshadowed by the public’s preconceived notions. Rosenfeld pointed to examples such as the Donald Trump legal cases and how media and public scrutiny can weigh heavily on the outcome.

Mental Health Law in Criminal Defense

Rosenfeld’s firm is also a leader in handling cases involving mental health, a growing area of concern in the legal system. He recounted a case involving a former city official who shot a police officer. The defense successfully argued that the individual had experienced a mental health crisis, leading to a dismissal of charges.

“Our laws have caught up to some degree. They’re still behind in some senses with the obvious idea that mental health issues exist. We as a society are much more transparent today than we were five years ago about people really having mental health trauma and mental health maladies,” Rosenfeld remarked. He stressed that mental health conditions are more widely recognized today, but the justice system must continue adapting to ensure fair treatment for those suffering from mental illness.

Navigating the Complexity of Legal Cases

Rosenfeld also touched on the importance of having experienced legal representation. Rosenfeld’s firm, which handles everything from DUI cases to high-profile federal offenses, has built a reputation for taking on some of the toughest legal challenges in California. With offices across the state, including in Sacramento and San Jose, the Rosenfeld Law Firm continues to be a key player in California’s legal landscape.
